TRUST ADMINISTRATION
Trust Administration is the process that would take place upon the death of someone with a Trust that was created for just them or with their spouse or registered domestic partner. While the process tends to be less costly and shorter than Probate, there are still procedures which must be followed to make sure the administration is effective and fair. The Acting Trustee is responsible to assure that appropriate notices are given, debts paid, taxes are filed, and assets distributed. If the decedent leaves significant assets outside their Living Trust, a Probate may be necessary to put those assets into the Trust via a Pour-Over Will. In most cases, the Trustee is well advised to hire an attorney to assure that the administration is done correctly.
